Buying a Short Sale Home in Arizona has become much easier over the years, though not every short sale is created equal. There are a lot of factors involved in a short sale, and the more information you have, the more accurate your expectations will be. Here are the top 7 questions you should ask when buying a short sale home in Arizona.

1. 1.      How many loans are involved with the short sale, and which banks are servicing the loan(s)? 

A short sale involving 2 loans with different banks can be significantly more difficult and time consuming than a short sale with only one loan or 2 loans with the same bank. Typically a loan in second position will only get a few thousand dollars from the sale, since it is wiped out at foreclosure and would receive nothing. Even so, second loans can still demand more and may even take it to foreclosure if not receiving the requested amount. It can be more difficult if the second is a HELOC—a loan which involves taking cash out of the mortgage. Often, these type of loans want a minimum of 10% which the first may or may not agree to.

1. 2.      Are there any other liens involved?

If there are any HOA liens, contractor liens, IRS liens etc. this also may prolong and make the short sale process difficult or even impossible. The majority of the time banks will not cover these liens, and the seller may be incapable or unwilling to cover as well. In many cases, the seller will ask YOU, the buyer, to cover these costs.

1. 3.      Does the Seller have a genuine hardship?

Banks will want to see that the seller has a genuine hardship, which could include loss of employment, lowered income, increased debt, medical issues etc. Sellers without hardships are often asked to contribute to the sale with an upfront payment or a promissory note. In some of these cases, sellers will opt for foreclosure (which cancels the short sale) as it is more beneficial to them.

1. 4.      Who is negotiating the short sale?

If the listing agent is the one negotiating a short sale, you can inquire into their experience and success in negotiating short sales. In some cases it is an Attorney or third party company negotiating—which you can also inquire on their experience/success. A proactive and experienced negotiator can really increase the success of the short sale.

1. 5.      What condition is the home in?

Nearly all short sales are sold AS-IS, meaning the seller is not offering any warranties on the home and most likely will not do any repairs. If you are utilizing FHA or conventional financing, there may be repairs that are necessary to obtain your loan. Since the probability of the seller completing them is not very high, the responsibility would fall to you.

1. 6.      What are the Comparables on the home?

Most listed short sales are not approved at the list price, and must get approval from the bank. The bank will either order an appraisal or a BPO (Broker Price Opinion) to obtain a value for the property. If the value comes in higher than the purchase price, the bank may counter your offer. Analyzing the last 3 months active, pending, and sold homes should give you an idea if the price is in line with market value.

1. 7.      What is your timeline for closing?

If you are looking for a quick close, buying a short sale home in AZ may not be a good fit. The average timeline of a short sale is 60-90 days, though could be much quicker or much longer depending on the factors above.
